GOP calls charges ‘ridiculous’<\/em><\/h2>\n

\"election2016\"<\/a>WEST CHESTER \u2014 The Chairman of the Chester County Democratic Party has filed voter fraud charges against Eric Roe, the Republican candidate for state house in the 158th District, alleging that Roe knowingly ran for State Representative, despite not meeting the commonwealth\u2019s residency requirements.<\/span><\/p>\n

The Democrats filed complaints with Chester County District Attorney Tom Hogan and Pennsylvania Attorney General Bruce Beemer late Thursday alleging that Roe has not been a resident of Pennsylvania for four years as required by the state Constitution, but lived in Washington D.C. possibly as late as September, 2013, while employed at a political action committee, while Republican officials say there is no issue and that the move is \u201cridiculous\u201d as Roe maintained his official residence in the county, using it for his drivers license and tax returns.<\/span><\/p>\n

Roe is facing off against Democrat Susan Rzucidlo in the November election. <\/span><\/p>\n

Brian McGinnis, chair of the Chester County Democrats, filed the complaint personally, saying that he had developed information that Roe has not been a resident of the state continuously since Nov. 8, 2012 \u2014 or four years from election day.<\/span><\/p>\n

\u201cEric Roe clearly does not meet the four-year Commonwealth residency requirement for State House Candidates,\u201d McGinnis said in a statement, issued Thursday evening. \u201cDespite our warnings after the Chester County Republicans endorsed Roe, the Republicans nominated a candidate who does not meet the constitutional requirements to serve. Eric Roe has misrepresented himself to the voters in the 158th<\/span> and now we are calling on Tom Hogan and Bruce Beemer to take action. If Donald Trump and the Republicans are so concerned about voter fraud, they should look in the mirror because Eric Roe\u2019s case is clear-cut fraud.\u201d <\/span><\/p>\n

As evidence, McGinnis provided a residency verification saying that Roe leased an apartment in Washington, D.C. through at least June, 2013. They also showed various Federal Election Commission finance reports showing Roe as first an employee of the Republican National Committee and the Chertoff Group, arguing that Roe was not a college student, but a working, full-time resident of Washington, D.C. The latter reports are from 2010 and 2012 and do not demonstrate any employment history past January, 2012.<\/span><\/p>\n

Republican Committee Chair Val DiGiorgio responded late Thursday night and rejected the claim, saying Democrats were trying to win a seat through charges that they cannot win otherwise at the polls.<\/span><\/p>\n

\u201cThis is what candidates do when they cannot win an election on the issues,\u201d DiGiorgio said. \u201cThey bring up ridiculous claims to divert the voter\u2019s attention from the real issues.\u201d<\/span><\/p>\n

DiGiorgio argued that Democrats have to resort to this sort of behavior because they do not have a competitive candidate in the race.<\/span><\/p>\n

\u201cThree-time failed candidate Susan Rzucidlo opposes pension reform and liquor privatization,\u201d DiGiorgio\u2019s statement said. \u201cShe supports the largest tax increase in the history of the Commonwealth, which would tax everything from daycare to college textbooks to senior living facilities and more. Since Susan cannot convince voters in her district that she agrees with them on these and other issues, she is touting a spurious claim about Eric Roe\u2019s residency.\u201d<\/span><\/p>\n

For the record, Rzucidlo \u2014 in a letter published here this week refuted those claims, suggesting that Roe \u2014 and now, by extension, DiGiorgio were lying about her stances on those issues.<\/span><\/p>\n

Neither Hogan nor Beemer\u2019s respective offices could be reached for comment last night \u2014 messages were left with both.<\/span><\/p>\n

Roe\u2019s eligibility to run has been a point of contention between Democrats and Republicans, with Democrats arguing that Roe, after graduating college, went to work for various political organizations in the nation\u2019s capital rather than returning to his native Pennsylvania. Roe and the Republicans have counter argued that Roe attended graduate school in England \u2014 and still considered a student with permanent residency in Pennsylvania. McGinnis argues that Roe continued on as an employee of the PAC Let Freedom Ring, a right-wing group fronted by former County Commissioner Colin Hanna. Democrats pointed to Roe\u2019s LinkedIn page which they say showed him working for Let freedom Ring after Nov., 2012 as a consultant.<\/span><\/p>\n

It will be up to investigators to decide the merits of the charges, but attorneys on both sides made their arguments, Thursday.<\/span><\/p>\n

In the complaint, drafted by local attorney Adam Bonin, it alleges: \u201cthe legal question is whether Roe was an inhabitant of Pennsylvania on November 8, 2012, and for the four years thereafter. He hasn\u2019t been. It\u2019s closer to two years, three months.\u201d <\/span><\/p>\n

Republican Committee Solicitor Joel Frank said the issue had been put to rest months ago.<\/span><\/p>\n

\u201cWhen this issue was first raised months ago, we performed a comprehensive analysis of the actual facts in light of the governing law and readily concluded that Eric met the statutory requirements to hold office,\u201d Frank said in a statement. \u201cAlthough we still have not seen the actual complaint, it is apparent to me that Mr. McGinnis and his cronies don\u2019t grasp or understand the applicable law. Their accusations are baseless, unfounded, and reckless.\u201d\u00a0<\/span><\/p>\n

The state Constitution requires State Representatives to be residents of the commonwealth for four years:<\/span><\/p>\n

\u201cSenators shall be at least 25 years of age and Representatives 21 years of age. They shall have been citizens and inhabitants of the State four years, and inhabitants of their respective districts one year next before their election (unless absent on the public business of the United States or of this State), and shall reside in their respective districts during their terms of service.\u201d<\/span><\/p>\n

Thursday\u2019s filing of charges is just the most recent drama in races involving the 158th District dating back to 2014, when then GOP candidate Cuyler Walker withdrew in September, citing personal reasons \u2014 and he was replaced on the ballot by the retiring State Rep. Chris Ross, who won reelection in November of 2014. This spring, Leonard Rivera, who won the endorsement of the party committee was forced to withdraw from the race after questions emerged about his nominating petitions.
